Maritime MaaS API’s terms of use
1 These terms of use and the agreement they form
The terms of use (‘Terms of Use’) described in this document apply to the use of the Maritime MaaS API (‘Interface’), owned by Forum Virium Helsinki and the Solution Agency of the City of Helsinki’s Culture and Leisure Division (‘Owners’).
The Terms of Use form the agreement between an Interface user and its Owners on the use of the Maritime MaaS API. If a user represents an organisation, the agreement will be between this organisation and the Owners of the Interface. Henceforth, a person or an organisation using the Interface will be referred to as an ‘Interface User’. In addition to the Terms of Use, an Interface User must comply with the terms and conditions pertaining to other related services, such as retail sellers’ applications and services, transport providers’ services. The terms of use described above are not mutually exclusive, and instead the Terms of Use describe the requirements that must be observed when using the Interface.
In order to use the Interface, an Interface User must agree to the Terms of Use described in this document.
2 Right of use
The Owners grant an Interface User a right to use the Interface in accordance with these Terms of Use. This right is free of charge, but not exclusive or transferable to a third party. The right of use will remain valid until further notice. An Interface User may terminate this right at any time by notifying the Interface Owners.
The source code is open, and currently the use of the Interface requires an agreement with a transport provider on the retail sails of ticket products.
The Owners have a right to withdraw an Interface User’s right of use, if they deem that the Interface User has used the Interface contrary to the Terms of Use, legislation or fair practice.
An Interface User may not:
circumvent any access or usage restrictions pertaining to the Interface
use the Interface for an activity or in a way that impedes other users’ ability to use the Interface
use the Interface to publish or distribute material that violates the rights of other people or organisations, is illegal, degrading, indecent or otherwise insulting or harmful.
3 Interface User’s responsibilities
An Interface User will be responsible for the acquisition, costs and functionality of all the equipment, software, and communication and telecommunication connections they require in order to use the Interface.
An Interface User must comply with the latest usage, safety and other guidelines of the Interface.
An Interface User will be responsible for any damage caused to the Owners, other Interface users, third parties and end users through the use of the Interface in a manner contrary to the Terms of Use, any other agreements’ terms and conditions, legislation or fair practice.
4 Interface User’s details and use of these
The implementation of the Interface requires an agreement between an individual transport provider and an operator interested in selling retail ticket products via the interface. The Owners do not collect data on these agreements, but will verify the validity of an agreement with the signees.

No identifiable data of individual users or information on payment transactions is shared via the Interface.
The Interface creates a usage log, which holds data on the calls and purchases passed on via the Interface. This log is not public and can only be viewed by users holding an Owners’ admin role. The log may be used to resolve any errors that occur in the Interface.
5 Intellectual property rights
The following licensing model of the City of Helsinki is applied to the use of the Interface’s source code:

6 Liability limitations
The Owners will do their best to ensure that the Interface works without problems or disruptions. However, the Owners cannot guarantee that the Interface is always available for use. Unforeseen outages or inability to use the Interface may occur, due to technical errors, other similar causes or faults caused by a third party.
The Owners monitor the Interface through technical means, and repairs are carried out on weekdays during office hours. The Owners will attempt to inform the users of any problems impeding the use of the Interface as quickly as possible. Wherever possible, the users are informed in advance of any maintenance that will prevent the use of the Interface completely.
The transport providers that have integrated with the Interface are responsible for the content and quality of the transport and ticket data passed on via the Interface, and the Owners of the Interface will not be responsible for the accuracy or correctness of the data transmitted via the Interface.
The Owners will not be responsible for any damage or resulting claims made to an Interface User, caused by an outage in the Interface.
The Owners will not be responsible for any damage to an Interface User caused by misuse of the Interface.
The Interface is provided ‘as is’, in accordance with the legislation in force.
7 Amendments to and validity of the Terms of Use
The Owners have the right to amend these Terms of Use. The latest Terms of Use can be found on the Maritime MaaS API’s wiki.
The Owners will notify those who have integrated with the Interface of amendments via email, and publish a notification on the Maritime MaaS wiki and via another suitable channel before changes become effective. Amendments become effective on the date announced. By continuing to use the Interface after an amendment to its Terms of Use, an Interface User agrees to comply with the new terms.
The other sections of the Terms of Use will remain valid even if one is deemed invalid or inapplicable.
8 Applicable law and resolution of disagreements
The agreement is governed by Finnish law.
If any questions, problems or disagreements occur, an Interface User must first contact the Maritime MaaS Support channel, as soon as possible: see up-to-date contact information here.
If a disagreement cannot be resolved through negotiations between the parties, the matter will be passed on to Helsinki District Court.
